These Terms & Conditions govern your use of gallerykhat.com and purchases made through it. Please read them before using the website or placing an order. By using the website or placing an order, you agree to these Terms & Conditions, the Privacy Policy and the Exchange & Return Policy.

1. About Khat Gallery

This website is owned and operated by Khat Gallery Company for Retail Sale of Gifts and Luxuries W.L.L., Commercial Registration No. 467553, State of Kuwait (“Khat Gallery”, “we”, “us” or “our”).

2. Eligibility and Accounts

You must provide accurate and current information when creating an account or placing an order and keep your account credentials confidential. You are responsible for activity carried out through your account unless you promptly notify us of unauthorised use.

If you are under 18 years of age, you must use the website and make purchases with the consent and supervision of a parent or legal guardian.

3. Products and Website Information

We aim to make product descriptions, images, prices and availability information as accurate as possible. However, actual colours or appearance may vary slightly because of screen settings, material characteristics or handmade production. Such variation is not a defect unless it is material.

All products are subject to availability. We may limit quantities per customer, discontinue a product, or change its description or price at any time, subject to applicable law.

4. Prices and Payment

Prices are displayed in the currency shown on the website and include or exclude taxes and fees as clearly indicated at checkout. Delivery charges and optional service fees may be added before you confirm an order.

We accept the payment methods made available at checkout. Payment is subject to verification and approval by the payment-service provider or card issuer. We are not responsible for a payment being declined by those parties.

5. Orders and Acceptance

An order-receipt confirmation or automated message does not mean that we have finally accepted your order. An order is accepted when we confirm its preparation, dispatch or delivery, as applicable.

We may reject or cancel an order, in whole or in part, for reasonable reasons such as product unavailability, an obvious pricing or description error, inability to verify payment or address details, suspected fraud, or a breach of these Terms. If we cancel an order after payment has been collected, we will refund the amount through the original payment method in accordance with applicable law.

6. Delivery and Collection

Available delivery and collection options are presented at checkout. Any delivery date or timeframe is an estimate unless expressly stated otherwise and may be affected by matters outside our control, such as an incorrect address, recipient unavailability or delivery-provider circumstances.

You must provide an accurate address and phone number and inspect the order on delivery where reasonably possible. If an item is visibly damaged or incorrect, please contact us in accordance with the Exchange & Return Policy.

7. Customised Products and Gift Cards

Customised products may require your approval of the design, wording or other details before production. You are responsible for the accuracy of content you provide and confirm that you have the right to use it. We are not obliged to produce content that is unlawful, offensive or infringes another person’s rights.

Customised products and gift cards are subject to the Exchange & Return Policy, including the restrictions set out in it, subject to applicable mandatory consumer rights.

8. Acceptable Use

You must not use the website unlawfully, fraudulently or in a way that harms the website, its users or the rights of others. You must not attempt unauthorised access to the website or its systems, use automated means to extract its content or disrupt its operation, or resell products for commercial purposes without our prior written consent.

13. Governing Law and Disputes

These Terms & Conditions are governed by the laws of the State of Kuwait. This does not affect any mandatory consumer rights under applicable law. We will first seek to resolve any complaint or dispute amicably through contact with us. If it cannot be resolved, the competent courts and authorities in the State of Kuwait shall have jurisdiction, unless applicable law requires otherwise.
